CLARIFICATION TEXT ON COOKIES



1. PURPOSE and SCOPE


This Cookie Clarification Text sets out the procedures and principles regarding the processing and management of cookie data of visitors on the website of KAYA DIAMOND MÜCEVHERAT TURİZM SANAYİ TİCARET A.Ş. (hereinafter referred to as VALS DIAMOND or “Company”) in accordance with the Law No. 6698 on the Personal Data Protection and the “GUIDE ON COOKIE APPLICATIONS” published by the Board.

 

This clarification text covers the processing of personal data through cookies, and cookies that are not used in personal data processing are out of scope. It will be valid for desktop and mobile websites or web applications within the Company.

 

2. COOKIE DESCRIPTION

 

A cookie is a type of text file placed on the user's device by website operators and transferred as part of the HTTP(S)3 (Hyper Text Transfer Protocol) request; they are low-size rich text formats that allow certain information about users to be stored on users' terminal devices when a website is visited.

 

3. TYPES OF COOKIES

 

Cookies are divided into types according to their duration, intended use and parties.

 

3.1. Cookies by Duration

 

- Session Cookies: Temporary and deleted when the browser is closed.

- Persistent Cookies: They are automatically deleted after a certain period of time and save user data. Through this cookie, the user's processed data is transmitted to the server each time the user visits a website. They can also be used to ensure that users do not re-enter their login information each time when logging into their accounts on websites.

 

3.2. Cookies by Intended Use

 

- Strictly Necessary Cookies: Essential for the operation of the website.

- Functional Cookies: Used for personalization and remembering preferences.

- Performance-Analytical Cookies: Analyze user behavior and are used to improve the website.

- Advertising/Marketing Cookies: Track online movements and display advertisements for personal interests.

 

3.3. Cookies by Party

 

- First-Party Cookies: Placed directly by the website visited.

- Third-Party Cookies: Placed by a different third party.

 

4. PERSONAL DATA PROCESSING CONDITIONS IN TERMS OF COOKIES

 

When processing personal data, the Company takes into account explicit consent or other data processing conditions in Articles 5 and/or 6 of the Law. If there is one of the conditions other than explicit consent, there is no need to obtain explicit consent. The Company assesses whether the purpose of data processing is based on one of the conditions other than explicit consent. If not, explicit consent is obtained.

 

Cookies Other Than Mandatory Cookies:

 

- Users' explicit consent is obtained and they are given the opportunity to change their consent.

 

- With the cookie management panel, users can make “on” or “off” preferences for all cookies other than mandatory cookies.

Pursuant to Article 5/2 of the Law on the Personal Data Protection, data is processed based on the conditions that “data processing is mandatory for the legitimate interests of the data controller” and “it is directly related to the establishment or performance of a contract”.

Social Plugin Tracking Cookies:

    • Social networks offer social plug-in modules that can be integrated into websites.
    • These modules may use third-party cookies for purposes such as behavioral advertising, analytics or market research.
    • These cookies are not considered as mandatory cookies as they are not considered “strictly necessary”.
    • Social networks cannot collect data from non-members without explicit consent.

 

Online Behavioral Advertising Cookies:

    • Explicit consent is required for behavioral advertising cookies.
    • These cookies are used for advertising purposes such as impression frequency, financial recording, advertising partnership, click fraud detection, research and market analysis, product development and debugging.
    • These purposes require explicit consent as they are not within the scope of services explicitly requested by the user.

 

4.2. Use of Cookies within the Terms of Processing Other Than Explicit Consent

 

Load Balancing Session Cookies (Criteria A):

    • Load balancing allows web server requests to be distributed through a pool of machines.
    • User requests are routed to the same server in the pool.
    • These session cookies are used to identify communication endpoints and do not require explicit consent under Criteria A.

 

Cookies Used for the Security of the Website (Criteria B):

    • o Security cookies prevent the site from being down due to security vulnerabilities.
    • o For example, cookies used by a firewall to limit user requests per session.
    • o These cookies are strictly necessary for the security of the site and access to the service requested by the user and are considered under Criteria B.
    • o The Company may rely on processing terms for these cookies that do not require explicit consent.

Your personal data may be transferred to domestic suppliers that provide services to ensure commercial security, secure storage of your personal data, electronic or physical data storage, backup services or systems in accordance with the data transfer conditions in Article 8 of the Personal Data Protection Law No. 6698.

 

9. TRANSFER ABROAD

 

The transfer of personal data abroad is based on the explicit consent of the data subject in accordance with Article 9 of the Law. The Company may transfer the personal data of the data subject abroad in cases where there is adequate protection provided that there are processing conditions in the second paragraph of Article 5 or the third paragraph of Article 6 of the Law No. 6698, or in the absence of adequate protection, the data controllers in Turkey and in the relevant foreign country undertake an adequate protection in writing and the Personal Data Protection Board has permission.

  • To request information if your personal data has been processed,
  • To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
  • To know the third parties to whom your personal data is transferred domestically or abroad,
  • To request correction of your personal data in case of incomplete or incorrect processing and to request notification of the transactions made within this scope to third parties to whom your personal data has been transferred,
  • To request the deletion or destruction of your personal data in the event that the reasons requiring its processing disappear, although it has been processed in accordance with the provisions of Law No. 6698 and other relevant laws, and to request notification of the transactions made within this scope to third parties to whom your personal data has been transferred,

  • To request compensation for damages in case you suffer damage due to unlawful processing of your personal data.

As personal data owners, if you submit your requests regarding your rights listed above to Vals Diamond in writing in accordance with paragraph 1 of Article 13 of the Personal Data Protection Law or by the methods specified in the Communiqué on the Procedures and Principles of Application to the Data Controller, your requests will be finalized free of charge as soon as possible and within thirty days at the latest. However, if the transaction requires an additional cost, Vals Diamond will charge the fee in the tariff determined by the Personal Data Protection Authority.
